In McCulloch v. Maryland (1819), the Court upheld Congress's power to charter the Second Bank of the United States. Chief Justice Marshall read the Necessary and Proper Clause to allow any means 'appropriate' and 'plainly adapted' to a legitimate end — not only means that are strictly indispensable. 12

The Court also struck down Maryland's tax on the bank. Under the Supremacy Clause a state cannot tax a lawful federal institution, because 'the power to tax involves the power to destroy.' 13

For a federalism essay, it is the precedent to cite when you explain how national power reaches beyond the enumerated list — and Hamilton's 1791 opinion defending a national bank shows the same argument nearly three decades earlier. 4
