Mediation in International Disputes

Mediation as a formal tool of international dispute settlement is enshrined in Article 33 of the UN Charter, which lists it among the peaceful means by which states must seek to resolve disagreements that endanger international peace and security. Its modern practice traces back through the Hague Conventions of 1899 and 1907 and matured during the Cold War, when third parties — sometimes states, sometimes the UN Secretary-General, sometimes regional bodies — brokered ceasefires and political settlements from the 1978 Camp David Accords to the 1995 Dayton Agreement on Bosnia. Norway's quiet facilitation of the Oslo Accords in 1993 and Algeria's mediation between the United States and Iran in 1981 demonstrated how smaller or neutral states can wield outsized influence by offering credible, discreet channels. Today mediation is more crowded and more contested. The African Union, ASEAN, the OSCE, the Arab League and ad hoc 'groups of friends' often operate alongside UN envoys, while non-traditional mediators such as Qatar, Türkiye, Oman and Switzerland have taken lead roles in talks involving Afghanistan, Ukraine, Gaza, Venezuela and Iran. Critics point to a track record of stalled processes — Syria, Libya, Yemen, the Sahel — and to concerns about 'mediator shopping' by parties seeking the most favorable broker. The UN Secretary-General's 2023 New Agenda for Peace called for renewed investment in preventive diplomacy and inclusive mediation, including the meaningful participation of women and civil society as required by Security Council Resolution 1325. The core debate before the committee is how to make mediation faster, more legitimate, and more durable: how to coordinate competing mediators, how to handle armed non-state actors and sanctioned parties, and how to ensure that agreements survive contact with domestic politics on both sides.

Advocacy in the international system grew out of the post-1945 human rights architecture: the Universal Declaration of Human Rights (1948), the two 1966 Covenants, and the gradual emergence of treaty bodies and special procedures. At the same time, advocacy has been transformed by digital tools — open-source investigation, satellite imagery, and social-media organizing — that allow smaller actors to document abuses in near real time, but also expose advocates to surveillance and reprisals. The committee must grapple with how advocacy can remain effective and legitimate amid this backlash: how to protect human rights defenders, how to preserve civic space at the UN, and how to balance the universality of rights against charges of selective enforcement and politicization.

Delegates must consider how to reinforce compliance with judgments and awards, how to reform or replace the WTO appellate function, and whether the proliferation of forums risks fragmenting international law or, instead, deepens the rule of law by giving states more credible alternatives to force.

Negotiation is also increasingly shaped by domestic polarization, social-media exposure of draft texts, and competition between blocs such as the G7, BRICS+ and the G77.
