The concept gained renewed prominence following the Taliban's return to power in Afghanistan in August 2021, after which a cascade of edicts barred women and girls from secondary and university education, most forms of employment, public parks, and unaccompanied travel. The Islamic Republic of Iran has also faced sustained scrutiny since the 2022 death in custody of Mahsa Amini and the ensuing 'Woman, Life, Freedom' protests, with UN fact-finding bodies documenting state policies of compulsory veiling and gender-based persecution. Legally, the debate centers on whether existing instruments — particularly the crime against humanity of persecution on gender grounds under Article 7(1)(h) and the crime of apartheid under Article 7(1)(j) of the Rome Statute — adequately capture systemic gender oppression, or whether a dedicated codification is required. UN Special Rapporteurs Richard Bennett and Javaid Rehman, alongside a coalition of states and civil society actors, have urged the International Law Commission to include gender apartheid in the Draft Articles on Prevention and Punishment of Crimes Against Humanity currently under negotiation in the Sixth Committee. Opponents argue that 'apartheid' should remain tethered to its racial origins and warn of definitional dilution. The issue now sits at the intersection of treaty drafting, universal jurisdiction prosecutions, and state responsibility. Whether gender apartheid crystallizes as an autonomous international crime will shape both prosecutorial strategy and the obligations of third states to prevent and not recognize such regimes.

Mass migration has become one of the defining transnational challenges of the early twenty-first century, with UNHCR reporting over 120 million forcibly displaced people worldwide by 2024 — a figure driven by the wars in Syria, Ukraine, Sudan, and Gaza, the Venezuelan exodus, climate-induced displacement in the Sahel and South Asia, and protracted crises in Myanmar and Afghanistan. Meanwhile, host states such as Türkiye, Lebanon, Jordan, Pakistan, Iran, Bangladesh, Colombia, and Uganda shoulder the largest absolute caseloads with limited international burden-sharing. Key legal questions now include the extraterritorial reach of human rights obligations to migrants intercepted at sea or processed in third countries, the threshold at which climate displacement triggers protection (following the UN Human Rights Committee's 2020 Teitiota views), the legality of instrumentalized migration as a hybrid pressure tactic, and the scope of states' positive duties to conduct search and rescue. The Jessup-style framing typically requires delegates to balance sovereign control of borders against erga omnes obligations toward those fleeing persecution, conflict, and disaster.

International sanctions — whether UN Security Council measures under Chapter VII or autonomous regimes adopted by the EU, United States, United Kingdom, and others — have expanded dramatically in scope and technical complexity since the 1990s. The unprecedented packages imposed on the Russian Federation after its 2022 invasion of Ukraine, combined with sectoral and 'smart' sanctions on Iran, the DPRK, Belarus, Syria, and Venezuela, generated transactional volumes that far exceed traditional compliance capacity. In response, governments, financial institutions, and shippers have turned to artificial intelligence for screening, beneficial-ownership tracing, vessel-tracking ('dark fleet' detection via satellite and AIS data), trade-finance anomaly detection, and the identification of sanctions evasion networks involving shell companies and cryptocurrency. This turn raises distinct international legal questions. The Security Council's Panels of Experts increasingly rely on machine-learning analysis of open-source intelligence, raising due-process concerns about listing and delisting under the 1267/1989/2253 ISIL/Al-Qaida regime, where the Office of the Ombudsperson already faces criticism for opacity. AI-generated 'false positives' can freeze assets of misidentified persons, implicating the right to property, the right to an effective remedy, and obligations under regional human rights instruments. Conversely, target states and sanctioned actors are deploying AI themselves — for ship-spoofing, deepfake-enabled fraud, and obfuscation of supply chains — provoking debate over the attribution of evasion conduct and secondary-sanctions enforcement against third-state nationals. Emerging governance frameworks intersect here: the EU AI Act (in force 2024), the 2024 UN General Assembly resolution on safe and trustworthy AI, the Council of Europe Framework Convention on AI, and OFAC compliance guidance all touch on the use of automated decision-making in sanctions enforcement. Delegates must weigh the effectiveness gains in implementing Article 25 and Article 41 Charter obligations against the procedural-fairness, data-protection, and state-responsibility implications of delegating sanctions decisions to algorithmic systems.

Although general international law does not prohibit changes of government as such, the post-Cold War period has witnessed a clear normative trend against the unconstitutional seizure of power. The recent wave of military takeovers in Mali (2020, 2021), Guinea (2021), Sudan (2021), Burkina Faso (2022), Niger (2023), and Gabon (2023), alongside Myanmar's 2021 coup, has tested these frameworks and exposed the limits of regional enforcement, including the abandonment of ECOWAS's threatened intervention in Niger. The legal consequences span several axes. First, questions of recognition and representation — who occupies a state's seat at the UN, who controls central bank reserves, and whose signatures bind the state on treaties — were illustrated by the UN Credentials Committee's deferrals on Afghanistan and Myanmar and by litigation over Venezuelan assets. Second, the application of jus cogens and Article 41 ARSIWA obligations of non-recognition and non-assistance arise where coups are accompanied by gross human rights violations. Third, the conduct of de facto authorities engages state responsibility under the effective control test (ARSIWA Articles 4, 9, and 10), even where they are denied international recognition. Fourth, coup leaders may incur individual criminal responsibility where takeovers involve crimes against humanity, as alleged before the ICC in relation to Myanmar. Contemporary debate focuses on whether an emerging norm against unconstitutional changes of government has crystallized at the universal level, the lawfulness of regional military responses such as ECOWAS's contemplated intervention by invitation of an ousted president, and the obligations of third states and international financial institutions toward regimes installed by force.
