Modern international sales law grew out of decades of effort to overcome the friction caused by divergent national contract regimes. Early twentieth-century unification work culminated in the 1964 Hague Conventions (ULIS and ULF), which drew limited adherence because they reflected primarily Western European legal traditions. UNCITRAL, established in 1966, took up the project and produced the United Nations Convention on Contracts for the International Sale of Goods (CISG), adopted in Vienna in 1980 and entering into force in 1988. The CISG provides a uniform framework for formation of contracts, obligations of buyers and sellers, passing of risk, and remedies for breach in cross-border sales of goods. The CISG now binds more than 95 states accounting for the bulk of world trade, including most major exporters and importers, though notable holdouts such as the United Kingdom, India, and South Africa remain. Its interpretation has generated a substantial body of case law and arbitral awards, supported by UNCITRAL's CLOUT system and scholarly digests. Persistent debates concern the scope of party autonomy to exclude the Convention, the meaning of "fundamental breach," the interaction between the CISG and domestic rules on validity, and the treatment of digital goods, software, and mixed contracts that increasingly dominate commerce. Contemporary issues before practitioners and arbitrators include the CISG's application to supply-chain disruptions and force majeure under Article 79, the influence of soft-law instruments such as the UNIDROIT Principles of International Commercial Contracts, and ongoing efforts to harmonize sales law with emerging regimes on electronic commerce, sustainability disclosures, and standard-form terms. The 2026 Vis Moot problem situates delegates within this evolving framework, requiring close engagement with CISG provisions and authoritative interpretive sources.

International commercial arbitration emerged as the dominant mechanism for resolving cross-border business disputes because national courts were often perceived as slow, parochial, or insufficiently expert in international transactions. The legal architecture rests on three pillars: the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, which obliges more than 170 contracting states to enforce arbitration agreements and awards with narrow grounds for refusal; the UNCITRAL Model Law on International Commercial Arbitration (1985, revised 2006), adopted in whole or part by dozens of jurisdictions; and the institutional rules of bodies such as the ICC, LCIA, SIAC, HKIAC, SCC, and ICDR. Together they support party autonomy, arbitrator independence, and limited judicial intervention. Despite this widely shared framework, significant tensions persist. Debates continue over the proper scope of arbitrator jurisdiction (kompetenz-kompetenz), the law governing the arbitration agreement, the standards for setting aside or refusing enforcement under Article V of the New York Convention, and the boundaries of public policy review. The rise of investor-state arbitration has prompted legitimacy critiques and reform work under UNCITRAL Working Group III, while concerns about cost, duration, diversity on tribunals, and third-party funding have driven institutional rule revisions. Sanctions regimes, parallel proceedings, and anti-suit injunctions issued by national courts have created further complications for cross-border enforcement. Current practice is also being reshaped by technology and new subject matter: virtual hearings normalized during the COVID-19 pandemic, cybersecurity protocols, the use of artificial intelligence in document review and drafting, and disputes arising from digital assets, ESG commitments, and supply-chain restructuring. The 2026 Vis Moot procedural problem situates delegates within this dynamic environment, requiring engagement with leading institutional rules, the Model Law, and the New York Convention.
