Forensic science encompasses the application of scientific methods—ranging from DNA analysis and toxicology to fingerprinting, ballistics, and digital forensics—to the investigation and adjudication of crimes. Modern forensic practice traces its lineage to 19th-century pioneers like Alphonse Bertillon and Francis Galton, but the field underwent a revolution with the advent of DNA profiling in 1986 and the establishment of national databases such as the FBI's CODIS in 1998. Forensic evidence has since become a near-constant feature of American criminal trials, shaping both prosecution strategy and jury perception. The field's authority has been seriously challenged in recent decades. The 2009 National Academy of Sciences report, 'Strengthening Forensic Science in the United States,' found that many widely accepted disciplines—bite mark analysis, hair microscopy, and even certain firearm and fingerprint comparisons—lacked rigorous scientific validation. The 2016 PCAST report reinforced these concerns. Wrongful convictions exposed by the Innocence Project have repeatedly traced back to flawed or overstated forensic testimony, prompting Daubert challenges and renewed scrutiny of expert qualifications. Today, courts and laboratories grapple with reform: accreditation standards through ANAB, error-rate disclosure, blind proficiency testing, and the proper scope of expert testimony under Federal Rule of Evidence 702 (amended in 2023) and state analogs like Ohio Evidence Rule 702. Mock trial scenarios increasingly test whether student attorneys can probe an expert's methodology, foundation, and the line between scientific certainty and advocacy.

Emerging technologies—artificial intelligence, machine learning, biometric surveillance, blockchain, autonomous vehicles, drones, and synthetic biology—are advancing faster than legislatures and courts can adapt. The American legal system traditionally evolves through case-by-case adjudication, a model that strains when technologies like generative AI or facial recognition raise novel questions of authorship, liability, evidentiary reliability, and constitutional rights. The 2023 explosion of generative AI tools and the use of algorithmic risk-assessment software in sentencing (challenged in *State v. Loomis*, 2016) illustrate the pace of change. Legislative responses have been uneven. The EU's AI Act (2024) provides a comprehensive risk-based framework, while the United States has relied on a patchwork of executive orders, sector-specific guidance from agencies like the FTC and NIST, and state laws such as Illinois's BIPA and California's CCPA. Courts have begun confronting AI-generated evidence, deepfake authentication under Federal Rule of Evidence 901, and questions about whether algorithmic outputs constitute hearsay or scientific evidence requiring a Daubert foundation. In the criminal context, predictive policing tools, ShotSpotter acoustic detection, license-plate readers, and AI-assisted forensic analysis raise overlapping concerns about reliability, bias, and defendants' confrontation rights. The Fourth Amendment, ratified in 1791, protects 'the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.' Drafted in reaction to British general warrants and writs of assistance, its core requirement is that searches be reasonable and, generally, supported by a warrant based on probable cause. For most of the 20th century, doctrine turned on physical trespass until *Katz v. United States* (1967) reoriented the inquiry around a 'reasonable expectation of privacy.' Consent operates as a foundational concept across multiple areas of American law: it can transform an otherwise unlawful search into a constitutional one, convert a battery into permissible contact, validate a contract, and serve as a complete defense to many criminal charges. In Fourth Amendment doctrine, *Schneckloth v. Bustamonte* (1973) established that consent to a search must be voluntary under the totality of the circumstances, though the suspect need not be informed of the right to refuse. *Georgia v. Randolph* (2006) and *Fernandez v. California* (2014) refined the rules for consent among co-occupants. Investigative genetic genealogy (IGG) combines traditional DNA analysis with consumer ancestry databases and genealogical research to identify criminal suspects and unidentified remains. The technique entered public consciousness with the April 2018 arrest of Joseph James DeAngelo, the 'Golden State Killer,' identified after investigators uploaded crime-scene DNA to the public GEDmatch database and traced family trees to a single suspect. Since then, IGG has been used in hundreds of cold cases nationwide, including high-profile investigations in Ohio and across the Midwest. The practice raises significant legal and ethical questions. Although users of services like 23andMe and AncestryDNA submit their own samples, IGG implicates the genetic privacy of relatives who never consented to law enforcement use.
