Criminal law in the United States is the body of rules that defines conduct prohibited by the state and prescribes punishment for those who violate it. Its roots trace back to English common law, which the American colonies inherited and adapted after independence. Over the nineteenth and twentieth centuries, states codified their criminal statutes, and the federal government developed a parallel criminal code under powers enumerated in the Constitution. The Model Penal Code, drafted by the American Law Institute in 1962, became an influential template that shaped reforms in most state codes, organizing offenses by mental state (mens rea) and conduct (actus reus). A criminal prosecution requires the government to prove every element of the charged offense beyond a reasonable doubt, the highest standard in American law. Defendants are protected by a web of constitutional guarantees drawn from the Fourth, Fifth, Sixth, Eighth, and Fourteenth Amendments, including the rights to counsel, to a jury trial, to confront witnesses, and to be free from compelled self-incrimination, double jeopardy, and cruel and unusual punishment. Landmark Supreme Court decisions such as Gideon v. Wainwright (1963), Miranda v. Arizona (1966), and In re Winship (1970) cemented these protections in modern practice. Today, debates in criminal law center on issues such as sentencing disparities, mandatory minimums, the scope of prosecutorial discretion, juvenile justice, the death penalty, and the appropriate balance between public safety and individual liberty. Mock trial competitions draw on this framework to test advocacy, evidentiary reasoning, and the ethical responsibilities of prosecutors and defense attorneys within an adversarial system.

The Fourth Amendment to the U.S. Constitution, ratified in 1791 as part of the Bill of Rights, protects 'the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures.' It was a direct response to British colonial practices, particularly the use of writs of assistance—general warrants that allowed customs officials to search homes and businesses at will. The Framers, influenced by cases like Entick v. Carrington (1765) in England, sought to require particularity and judicial authorization before the government could intrude on private spaces. For much of the nineteenth century, the Fourth Amendment was rarely litigated, but the twentieth century produced a rich body of doctrine. Weeks v. United States (1914) established the federal exclusionary rule, and Mapp v. Ohio (1961) extended it to the states through the Fourteenth Amendment. Katz v. United States (1967) reframed the inquiry around a person's 'reasonable expectation of privacy,' moving beyond strictly physical trespass. Subsequent cases carved out numerous exceptions to the warrant requirement, including consent searches, automobile searches, stop-and-frisk under Terry v. Ohio (1968), exigent circumstances, and the good-faith exception in United States v. Leon (1984). Contemporary Fourth Amendment debates focus on how traditional doctrine applies to modern technology and policing practices. Decisions such as Riley v. California (2014), which required a warrant to search a cell phone incident to arrest, and Carpenter v. United States (2018), which extended warrant protections to historical cell-site location data, illustrate the courts' ongoing effort to adapt eighteenth-century text to digital-age surveillance. Mock trial problems frequently turn on whether evidence was lawfully obtained, making Fourth Amendment analysis central to suppression motions and trial strategy.
