Modern labour law emerged from the industrial conflicts of the late nineteenth and early twentieth centuries, when rapid industrialization created sharp imbalances of power between employers and workers. Strikes, lockouts, and unrest pushed governments to recognize unions, regulate working conditions, and establish frameworks for collective bargaining. The International Labour Organization, founded in 1919 under the Treaty of Versailles, set early global standards on freedom of association, hours of work, and protection against forced labour, and its conventions continue to anchor national labour regimes. In Canada, the 1944 Wartime Labour Relations Regulations (P.C. 1003) — modelled in part on the U.S. Wagner Act of 1935 — entrenched the duty to bargain in good faith, exclusive union representation, and the prohibition of unfair labour practices. The 1946 Rand Formula, arising from a Ford strike in Windsor, established compulsory dues check-off and became a cornerstone of Canadian industrial relations. Provincial labour relations boards and federal tribunals now administer certification, bargaining, and unfair labour practice complaints. Contemporary debates focus on the scope of constitutional protection for collective bargaining and the right to strike, recognized by the Supreme Court of Canada in Health Services (2007) and Saskatchewan Federation of Labour (2015); the classification of gig and platform workers; sectoral bargaining models; and the persistence of precarious work. Globalization, automation, and remote work continue to test whether traditional labour law frameworks can deliver substantive protection.

Labour arbitration developed as an alternative to industrial warfare, offering a binding, expert-led method of resolving disputes during the term of a collective agreement. In Canada, statutory prohibitions on mid-contract strikes — first codified during the Second World War and entrenched in postwar legislation such as Ontario's Labour Relations Act — required that all differences arising from the interpretation, application, or alleged violation of a collective agreement be settled by final and binding arbitration. Grievance arbitration thereby became the central adjudicative forum for unionized workplaces. Arbitral jurisprudence has built a substantial body of common law on issues such as just cause for discipline and discharge, progressive discipline, the management rights doctrine, accommodation of disability, estoppel, and the admissibility of evidence. Leading decisions — including the Supreme Court of Canada's rulings in Weber v. Ontario Hydro (1995) on exclusive arbitral jurisdiction, Parry Sound (2003) on the incorporation of human rights statutes into collective agreements, and McKinley v. BC Tel (2001) on contextual assessment of cause — have shaped how arbitrators approach their mandate. Interest arbitration, used to settle the terms of a collective agreement itself (particularly in essential services), raises distinct questions about replication, comparability, and ability to pay. Current issues include the procedural efficiency and cost of arbitration, the use of expedited and mediation-arbitration hybrids, the treatment of off-duty conduct and social media, post-pandemic disputes over vaccination policies and remote work, and the increasing intersection of arbitration with human rights, privacy, and occupational health and safety regimes.

Employment law governs the individual contractual relationship between employer and employee outside the collective bargaining context. Rooted in the common law of master and servant, it has been progressively overlaid by statute: employment standards legislation establishing minimum wages, hours, vacation, and termination entitlements; human rights codes prohibiting discrimination; occupational health and safety statutes; pay equity and accessibility legislation; and privacy laws regulating workplace surveillance and personal information. The common law has developed alongside these statutes, most notably through the doctrine of reasonable notice on termination without cause, refined in Bardal v. Globe & Mail (1960) and subsequent appellate jurisprudence. The Supreme Court of Canada's decisions in Wallace v. United Grain Growers (1997), Honda Canada v. Keays (2008), and Matthews v. Ocean Nutrition (2020) have shaped damages for the manner of dismissal and for lost incentive compensation. Courts continue to wrestle with the enforceability of termination clauses, restrictive covenants, and the boundary between employees, dependent contractors, and independent contractors. Today's pressing questions concern the regulation of platform and gig work, the right to disconnect, workplace mental health, pay transparency, the use of artificial intelligence in hiring and monitoring, and post-pandemic norms around hybrid and remote work. Jurisdictions are increasingly experimenting with statutory presumptions of employment status, sectoral standards for app-based workers, and enhanced enforcement of employment standards against wage theft and misclassification.
