After the catastrophes of the two World Wars, the United Nations Charter (1945), the Universal Declaration of Human Rights (1948), and the Geneva Conventions (1949) consolidated a postwar legal order built on prohibitions against aggression, protections for civilians, and respect for human rights. The core dispute today concerns whether international law genuinely binds powerful states or merely reflects the preferences of those who wrote it. Critics from the Global South argue that institutions like the UN Security Council entrench the privileges of victors of 1945, while major powers increasingly accuse one another of selective compliance — invoking law when convenient and ignoring it otherwise. Recent flashpoints, including the wars in Ukraine and Gaza, arrest warrants issued by the International Criminal Court, and disputes over freedom of navigation in the South China Sea, have intensified debate over the credibility of legal norms. At present, the international legal system stands at a crossroads between fragmentation and reform. Multilateral treaty-making has slowed, while regional and bilateral arrangements proliferate. Proposals to expand Security Council membership, strengthen the ICC, codify cyber norms, and develop new rules for artificial intelligence and outer space are all under active discussion, but consensus remains elusive.

International court procedures evolved from ad hoc arbitration in the 19th century into a network of permanent tribunals over the course of the 20th. The Permanent Court of Arbitration (1899) and the Permanent Court of International Justice (1922) established that disputes between states could be adjudicated rather than fought, and the International Court of Justice (ICJ), created in 1945 as the principal judicial organ of the United Nations, inherited and expanded that role. The ICC faces persistent challenges over its reach: several major powers, including the United States, China, Russia, and India, are not parties to the Rome Statute, and African and Asian states have at times accused the Court of geographic bias. Recent ICC arrest warrants against sitting heads of state, and ICJ proceedings on alleged genocide and occupation, have raised fundamental questions about how courts can compel compliance from powerful actors. The system continues to develop through specialized tribunals — the International Tribunal for the Law of the Sea, the WTO dispute settlement system, and investor-state arbitration panels — each with distinct rules of standing, evidence, and remedy. Reform debates focus on streamlining proceedings, protecting judicial independence, and reconciling overlapping jurisdictions.

The world's legal systems trace to a small number of foundational traditions: civil law derived from Roman codifications and consolidated in the Napoleonic Code (1804); common law developed through English judicial precedent and exported across the British Empire; religious legal systems, including Islamic law (sharia), Jewish halakha, and canon law; and customary and indigenous legal orders that predate or coexist with state codification. Socialist legal traditions, shaped in the 20th century in the Soviet Union and China, added another layer, and many contemporary states operate hybrid systems blending several sources. The principal contemporary disputes concern how these systems interact under conditions of globalization. Cross-border commerce, migration, and digital activity routinely place transactions and individuals under multiple legal regimes simultaneously, raising questions of choice of law, recognition of foreign judgments, and human rights compatibility. Tensions are particularly visible where universal human rights norms meet domestic legal traditions — for example, in debates over capital punishment, criminal procedure, women's rights, and freedom of expression. Efforts at harmonization, such as UNCITRAL model laws, the Hague Conventions on private international law, and regional integration in the EU and African Union, have made progress but remain uneven. Today, comparative legal questions are increasingly central to the legitimacy of international institutions. Debates over judicial independence, anti-corruption frameworks, rule-of-law conditionality in development assistance, and the regulation of emerging technologies all require reconciling distinct legal cultures. Whether a genuinely pluralist global legal order can coexist with universal standards remains an open and contested question.
