Causes of Wrongful Convictions

Research by the Innocence Project and other organizations has identified the leading causes of wrongful convictions. Eyewitness misidentification is the most common factor, present in approximately 69% of DNA exonerations. False confessions, often obtained through coercive interrogation techniques, contribute to about 29% of cases. Jailhouse informants who receive incentives to testify, junk forensic science, prosecutorial misconduct, and inadequate defense counsel are other significant factors.

These causes are not random errors. They are systemic problems embedded in how the criminal justice system operates. The psychology of eyewitness memory is well understood, yet most police departments have been slow to adopt evidence-based identification procedures. Interrogation techniques that produce false confessions remain in widespread use.
