Withdrawal Under Treaty Provisions
Most modern treaties include withdrawal clauses specifying the procedure and notice period. The Paris Agreement requires one year's notice, the NPT requires three months, and the Rome Statute requires one year. Some treaties are designed to be permanent and contain no withdrawal clause, like the Genocide Convention and the UN Charter.
When a treaty is silent on withdrawal, the VCLT provides that withdrawal is permitted only if the parties intended to allow it or if a right of withdrawal can be implied from the nature of the treaty. This creates a strong presumption against withdrawal from treaties that do not expressly permit it.
