Team Strategy and Case Splits

How to organize a mock trial team — assigning roles, dividing the case, coordinating strategy, and building a cohesive presentation.

The Anatomy of a Mock Trial Team

A standard mock trial team fields six to eight members per trial: typically three attorneys and three witnesses, though some competitions allow variations. Each team must be prepared to argue both sides of the case, since most competitions require teams to switch between prosecution/plaintiff and defense across rounds. This means every team member needs to understand the entire case, not just their individual role.

Role assignment is one of the most consequential decisions a team makes. Attorneys are usually divided by function: one handles opening statement and direct examination of the first witness, a second handles direct of the second witness and cross-examination of an opposing witness, and the third handles cross-examination and the closing argument. Some teams assign opening and closing to the same attorney for thematic consistency; others split them to distribute the workload.

Witness casting should match the character in the affidavit as closely as reasonable, but performance ability matters more than surface similarity. A confident, articulate team member will make a better expert witness than someone who matches the character's description but freezes under cross-examination. Cast for skill first and character fit second.
