South Africa v. Israel

The ongoing genocide case at the ICJ and its significance for international law and accountability.

Background

On December 29, 2023, South Africa filed a case at the ICJ alleging that Israel was committing genocide against the Palestinian people in Gaza. South Africa invoked Article IX of the Genocide Convention and requested urgent provisional measures. The case came in the context of Israel's military campaign in Gaza following the October 7, 2023 Hamas attacks, which killed approximately 1,200 people in Israel.

South Africa's application documented the scale of destruction in Gaza, including mass civilian casualties, the destruction of infrastructure, displacement of the population, and statements by Israeli officials that South Africa argued demonstrated genocidal intent. Israel rejected the allegations, arguing it was exercising self-defense against Hamas and that South Africa was seeking to weaponize the Genocide Convention.
