The Human Rights Treaty System

ICCPR, ICESCR, and the binding treaty system.

The UDHR was a declaration — morally powerful but not legally binding. To create enforceable obligations, the UN developed binding treaties. The two core treaties, both adopted in 1966, are:

International Covenant on Civil and Political Rights (ICCPR)

  • 173 states parties
  • Covers: right to life, freedom from torture, fair trial, privacy, free speech, assembly, religion
  • Monitored by the Human Rights Committee (18 independent experts)
  • Has an Optional Protocol allowing individual complaints

International Covenant on Economic, Social and Cultural Rights (ICESCR)

  • 171 states parties
  • Covers: right to work, education, health, adequate standard of living, cultural participation
  • Monitored by the Committee on Economic, Social and Cultural Rights
  • Rights are to be achieved "progressively" — states must show they're making progress, not achieve everything immediately

The UDHR + ICCPR + ICESCR together form the International Bill of Human Rights.
