The traditional treaty model faces several challenges. The sheer number of multilateral treaties creates treaty fatigue and fragmentation. Important global issues like AI governance, cyber security, and pandemic preparedness demand rapid international responses that the slow treaty process may not deliver. Domestic political polarization, particularly in the US, makes formal ratification increasingly difficult.

Climate change negotiations have pushed the boundaries of treaty design with the Paris Agreement's bottom-up approach: nationally determined contributions (NDCs) instead of top-down binding targets. This model may be the future of multilateral treaty-making, offering flexibility at the cost of enforceability.
