Navigational Freedoms Under UNCLOS

Freedom of navigation is a foundational principle of the law of the sea. UNCLOS protects the right of ships to transit through territorial seas (innocent passage), international straits (transit passage), and archipelagic waters (archipelagic sea lanes passage). On the high seas and in EEZs, all states enjoy freedom of navigation.

The US Freedom of Navigation (FON) program, established in 1979, sends naval vessels to challenge what it considers excessive maritime claims by any state — allies and adversaries alike. Since 2015, FON operations (FONOPs) in the South China Sea have become the most visible and contentious, with US warships sailing within 12 nm of Chinese-built artificial islands.
