Executive Agreements

International agreements that bypass the formal treaty process, particularly in US practice.

What Are Executive Agreements?

Executive agreements are international agreements concluded by the executive branch of government without formal legislative approval. In the United States, the distinction is significant: treaties (under Article II of the Constitution) require Senate advice and consent by a two-thirds majority, while executive agreements can be concluded by the President alone or with a simple majority of Congress.

Under international law, executive agreements are treaties. The VCLT does not distinguish between treaties approved by legislatures and those concluded by executives. The distinction is a matter of domestic constitutional law, but it has enormous practical consequences: most US international agreements are executive agreements, not Article II treaties.
