Entry into Force

When and how treaties become legally binding, and what happens in the interim period.

Entry into Force Thresholds

A treaty enters into force according to its own provisions. Bilateral treaties typically enter into force when both states exchange or deposit instruments of ratification. Multilateral treaties usually require a minimum number of ratifications. The Rome Statute required 60 ratifications, the NPT required ratification by three depositary governments plus 40 others, and the Paris Agreement required 55 parties representing 55% of global greenhouse gas emissions.

The threshold is a political judgment. Set it too high and the treaty may never enter into force. Set it too low and it may lack legitimacy or effectiveness. The Paris Agreement's double threshold (parties and emissions percentage) ensured that entry into force reflected both broad participation and meaningful coverage.
