Depositaries

The institution responsible for managing treaties after they are adopted, from receiving ratifications to notifications.

The Depositary's Role

A depositary is the state or international organization entrusted with custody of a treaty and the performance of administrative functions. The depositary receives instruments of ratification, accession, and withdrawal, registers the treaty with the UN Secretariat, notifies parties of actions affecting the treaty, and keeps the original authenticated text. For most multilateral treaties negotiated under UN auspices, the UN Secretary-General serves as depositary.

The depositary acts impartially and does not interpret the treaty or judge the validity of reservations. If a question about a reservation's compatibility arises, the depositary transmits it to the parties and lets them decide. This neutrality is essential for maintaining the integrity of the treaty process.
