Bail and Pretrial Detention

How different countries decide whether to detain or release suspects before trial, and the inequality of money bail.

Bail Systems Compared

Bail is the mechanism by which a person accused of a crime is released pending trial. The US uses money bail: defendants post a cash deposit or bond to guarantee their appearance at trial. Those who cannot afford bail remain in jail. This system creates a two-tier system of justice where wealth determines liberty before conviction.

Most other democracies do not use money bail. The UK releases most defendants on personal recognizance (a promise to appear) or with conditions like reporting requirements. Germany and France base pretrial detention on risk assessment: the judge evaluates flight risk, danger to the public, and the risk of interfering with evidence. The emphasis is on pretrial liberty as the default, with detention as the exception.
