Air and Missile Warfare

The rules governing aerial bombardment, missile strikes, and the protection of civilians from air attacks.

Legal Framework

There is no comprehensive treaty specifically governing air warfare. The 1923 Hague Rules of Air Warfare were never adopted as a binding treaty. Instead, air and missile warfare is governed by the general principles of IHL (distinction, proportionality, precaution), the Additional Protocols, and customary international law. The Harvard Manual on International Law Applicable to Air and Missile Warfare (2009) is the leading non-binding restatement.

The absence of a specific treaty means that applying IHL to air operations requires interpreting general rules in the context of aerial combat. The principles are clear: air attacks must target military objectives, must not cause excessive civilian harm, and must take precautions to minimize collateral damage.
