International commercial arbitration emerged as the dominant mechanism for resolving cross-border business disputes over the course of the twentieth century, as parties sought neutral, enforceable, and specialized alternatives to national court litigation. Its modern architecture rests on two foundational instruments: the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, which obliges its more than 170 contracting states to recognize arbitration agreements and enforce awards with only narrow grounds for refusal, and the 1985 UNCITRAL Model Law on International Commercial Arbitration (revised in 2006), which has been adopted in some form by over 85 jurisdictions and harmonizes core procedural standards. Substantive disputes arising from sales of goods are frequently governed by the 1980 United Nations Convention on Contracts for the International Sale of Goods (CISG), now in force in more than 95 states and the central instrument tested in the Vis Moot problem each year. The Willem C. Vis International Commercial Arbitration Moot, founded in 1993 by Eric Bergsten at the Institute of International Commercial Law in Vienna, was created to train the next generation of practitioners in the CISG and in arbitration practice. Each annual problem pairs a CISG-based substantive dispute with a procedural arbitration question, drawing on the rules of a major institution such as the ICC, LCIA, SIAC, HKIAC, VIAC, or SCC. Pre-moots like the CEU Vienna Pre-Moot serve as preparatory rounds in which teams test their oral pleadings before the Vienna and Hong Kong final rounds. Today the field faces several contested questions that frequently surface in Vis problems and in practice: the scope of arbitrator independence and disclosure duties following decisions such as Halliburton v Chubb; the treatment of third-party funding and security for costs; the interaction between arbitration and emerging issues like sanctions compliance, cybersecurity, and ESG-related claims; and persistent debates over the enforceability of awards under Article V of the New York Convention, particularly where awards have been set aside at the seat. The CISG itself continues to generate interpretive disputes over conformity of goods, fundamental breach, and the interplay with party-chosen standard terms.
