Treaty Amendment

How treaties are modified after entry into force and the challenges of amending multilateral agreements.

Amending Treaties

Treaties can be amended by agreement of the parties. The VCLT provides default rules: any proposal to amend a multilateral treaty must be notified to all parties, all parties have the right to participate in the decision and negotiation, and the amending agreement must be open to all parties. In practice, most major treaties contain their own amendment provisions that specify the procedure and the number of parties needed to adopt an amendment.

Amendment is conceptually simple but practically difficult for multilateral treaties. A treaty with 190 parties cannot easily be reopened for negotiation without risking the entire agreement. This is why many treaties use protocols or conference decisions to update their provisions rather than formal amendment.
