Judicial Capture

How the capture of courts — the last line of defense for democratic rights — enables authoritarian consolidation.

Independent courts are the ultimate check on executive power. They can strike down unconstitutional laws, protect minority rights, and hold leaders accountable. This is precisely why judicial capture is central to the authoritarian playbook.

Common techniques include: Court-packing — adding new seats filled with loyalists (as Orban did in Hungary). Forced retirement — lowering the retirement age to remove independent judges (as Poland's PiS government attempted). Disciplinary control — creating mechanisms to punish judges who rule against the government. Constitutional tribunal capture — ensuring the body that interprets the constitution is controlled by allies.

Once the judiciary is captured, the remaining democratic structures become hollow. Elections can be manipulated because courts will not intervene. Opposition leaders can be prosecuted on politically motivated charges. Constitutional amendments can be rubber-stamped.
