The Legal Gap

People displaced by climate change — rising sea levels, desertification, extreme weather events — do not meet the 1951 Convention's definition of a refugee. Climate change is not 'persecution,' and it is not linked to race, religion, nationality, social group, or political opinion.

The term 'climate refugee' is widely used in media and advocacy but has no legal status. UNHCR officially prefers 'persons displaced in the context of climate change and disasters' — a deliberately unwieldy phrase that reflects the absence of a clear legal framework. This gap leaves millions of people displaced by environmental factors without international protection.

Scale and Proposals

The World Bank estimates that by 2050, up to 216 million people could be internally displaced by slow-onset climate impacts — water stress, crop failure, sea-level rise — across six regions. Small island states like Tuvalu, Kiribati, and the Marshall Islands face the existential prospect of becoming uninhabitable.

Proposals for addressing the gap include: expanding the Refugee Convention to cover climate displacement (opposed by many states and UNHCR, which fears reopening the Convention could weaken existing protections); creating a new standalone treaty; developing regional frameworks; or using existing human rights law — in 2020, the UN Human Rights Committee ruled that returning a person to a country where climate change poses an imminent threat to life could violate the right to life.
