Case Study: The Uyghurs in Xinjiang

Since 2017, the Chinese government has conducted a massive campaign against the Uyghur population and other Turkic Muslims in Xinjiang province — what the UN Human Rights Office has called "serious human rights violations" that "may constitute crimes against humanity."

Background:

• The Uyghurs are a Turkic Muslim ethnic group, roughly 12 million people, concentrated in Xinjiang (northwest China)
• China views Xinjiang as strategically important (borders eight countries, rich in resources)
• After sporadic violence attributed to Uyghur separatists, China launched a sweeping crackdown framed as counter-terrorism

What has been documented:

• An estimated 1-1.8 million people detained in what China calls "vocational education and training centers" — what leaked internal documents and satellite imagery reveal as internment camps
• Forced labor in cotton and polysilicon production (Xinjiang produces ~20% of the world's cotton)
• Systematic destruction of mosques and religious sites
• Forced sterilizations — Uyghur birth rates in Xinjiang dropped by ~50% between 2015 and 2018
• Digital surveillance using facial recognition, phone scanning, and biometric data collection

Applying Course Concepts

Treaty obligations: China has ratified the ICESCR and CERD (racial discrimination convention). The detention, forced labor, and cultural destruction arguably violate both. China has signed but not ratified the ICCPR.

Human Rights Council: The HRC debated the Xinjiang situation in October 2022. A vote to hold a debate on the issue failed 19-17 (with 11 abstentions) — developing countries that depend on Chinese investment largely voted no.

Sovereignty vs. rights: China argues Xinjiang is an internal matter and accuses critics of interfering in domestic affairs. It frames the camps as counter-terrorism. This is the sovereignty-vs-rights tension at its starkest.

R2P limitations: R2P theoretically applies to crimes against humanity, but China's P5 veto and economic power make intervention unthinkable. No country will risk confrontation with a nuclear-armed superpower over human rights.

Economic entanglement: Global supply chains run through Xinjiang. The Uyghur Forced Labor Prevention Act (US, 2021) bans imports from Xinjiang, but enforcement is difficult when cotton and polysilicon are processed through multiple countries before reaching consumers.
