## How to prepare

Participants preparing for the Willem C. This includes in-depth study of the UNCITRAL Model Law on International Commercial Arbitration and the Convention on Contracts for the International Sale of Goods (CISG), which form the substantive legal framework for the competition. Mastery of these instruments is critical for constructing compelling arguments for both claimant and respondent.

Effective preparation also involves extensive practice in legal research and writing, as participants are required to draft detailed memoranda for both sides of a hypothetical dispute. ### International Commercial Arbitration

International commercial arbitration emerged in the twentieth century as the dominant mechanism for resolving cross-border business disputes, offering parties a neutral forum, enforceable awards, and procedural flexibility that national courts often could not provide. Its modern legal architecture rests on the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards, now ratified by more than 170 states, which obliges contracting states to enforce arbitral awards rendered abroad with only narrow grounds for refusal. This was complemented by the 1985 UNCITRAL Model Law on International Commercial Arbitration (revised in 2006), which has been adopted, in whole or in part, by over 85 jurisdictions and has done much to harmonize national arbitration statutes. The 1980 United Nations Convention on Contracts for the International Sale of Goods (CISG) supplies the substantive sales law most frequently applied in moot problems and in real-world cross-border transactions. Despite this convergence, significant tensions persist. Debates continue over the proper scope of party autonomy, the law governing the arbitration agreement, the use and limits of emergency and interim measures, the role of third-party funding, transparency obligations, and the treatment of issues such as consolidation, joinder, and multi-contract disputes. Institutional rules — including those of the ICC, LCIA, SIAC, HKIAC, SCC, VIAC, and CIETAC — compete and converge in shaping best practice, while national courts continue to differ on questions such as the doctrine of separability, anti-suit injunctions, and the public-policy exception to enforcement. Recent reforms to the UNCITRAL framework, the 2018 Singapore Convention on Mediation, and ongoing work on investor-state dispute settlement reform have further blurred the line between commercial arbitration and adjacent dispute-resolution regimes. Today the field faces pressures from several directions at once: calls for greater diversity among arbitrators, scrutiny of costs and delays, the impact of sanctions regimes on the conduct and enforcement of arbitrations, the rise of cybersecurity and data-protection obligations, and the integration of artificial intelligence into case management and advocacy. The Willem C. Vis Moot focuses each year on a procedural arbitration question and a substantive CISG question arising from a hypothetical commercial dispute, training future practitioners in the doctrines, institutional rules, and strategic choices that define contemporary international commercial arbitration.
